Consent for promotional email or other commercial marketing communications is handled separately where required.

4. Marketing Communications and CASL

AiWhyOh Digital may send commercial electronic messages only where we have a lawful basis to do so, including valid express or implied consent where permitted.

Marketing messages will include appropriate sender identification and an unsubscribe mechanism. You may unsubscribe at any time. CASL generally requires commercial electronic messages to have consent, identification information, and a functional unsubscribe option.

Our website may use cookies and similar technologies for:

  • essential website functionality

  • analytics

  • performance measurement

  • user experience improvements

  • advertising attribution

  • remarketing or audience measurement, where enabled

We may use third-party tools such as Google Analytics, advertising platforms, scheduling tools, CRM systems, or website technologies.

Where appropriate, users will be given information or choices regarding non-essential tracking technologies.

We do not sell personal information.

We may provide information to trusted service providers that help us operate our business, including:

  • hosting providers

  • CRM platforms

  • email marketing providers

  • analytics platforms

  • scheduling tools

  • advertising platforms

  • accounting or invoicing systems

We limit sharing to what is reasonably required for the service being provided.

PIPEDA requires organizations to remain accountable for personal information under their control and to protect it through appropriate safeguards.

7. International Processing

Some third-party technology providers may process or store information outside Canada, including in the United States.

Where this occurs, the information may be subject to the laws of the jurisdiction in which it is processed. We take reasonable steps to select reputable providers and protect information entrusted to them.

8. Data Retention

We retain personal information only as long as reasonably necessary for the purposes for which it was collected or as required for legal, accounting, contractual, or business purposes.

When information is no longer required, we may securely delete, destroy, or anonymize it. PIPEDA specifically requires organizations to limit retention to what is necessary for the identified purposes.

These may include:

  • access controls

  • secure passwords

  • reputable cloud services

  • encryption where appropriate

You may contact us to request:

  • access to personal information we hold about you

  • correction of inaccurate information

  • information about how your data has been used or disclosed

  • withdrawal of consent where applicable

We may need to verify your identity before responding to certain requests.

PIPEDA gives individuals rights relating to access, correction, openness, and challenging an organization’s privacy practices.

Accessibility Commitment

AiWhyOh Digital is committed to providing services in a manner that respects the dignity, independence, integration, and equal opportunity of people with disabilities.

Ontario’s AODA applies accessibility requirements to organizations that provide goods, services, or facilities, including professional service businesses.

11. Accessible Communication

We will make reasonable efforts to communicate with people with disabilities in ways that consider their accessibility needs.

Upon request, we will work with individuals to provide information in an accessible format or with appropriate communication support, where reasonably available.

Ontario accessibility guidance requires organizations to consider accessible formats and communication supports and to make accessibility information available to the public.

12. Website Accessibility

AiWhyOh Digital aims to design and maintain its website using recognized accessibility best practices.

This includes, where practical:

  • readable colour contrast

  • descriptive headings

  • keyboard-friendly navigation

  • meaningful link labels

  • alternative text for important images

  • readable font sizes

  • accessible forms

  • clear error messages

  • mobile-responsive layouts

For Ontario organizations with 50 or more employees, applicable AODA web accessibility requirements include WCAG 2.0 Level AA requirements for public websites and web content, subject to prescribed exceptions. Smaller organizations have different formal obligations, although following these standards remains a strong accessibility practice.

13. Accessibility Feedback

We welcome feedback about the accessibility of our website and services.

If you experience a barrier, you may contact us and tell us:

  • what barrier you encountered

  • what format or support would help

  • how we can contact you

We will review accessibility feedback and take reasonable action where appropriate.

Ontario organizations with one or more employees must have a process for receiving and responding to accessibility feedback and make information about that process publicly available.

14. Third-Party Platforms

Our website and services may rely on third-party platforms such as Google, Meta, LinkedIn, Shopify, Amazon, Squarespace, Calendly, or other software providers.

AiWhyOh Digital cannot control the accessibility, privacy practices, or technical operation of third-party services. Users should review the applicable policies of those providers.

15. Policy Updates

We may update this policy as our services, technologies, business practices, or legal obligations change.

The latest version will be posted on our website with the updated effective date.
